i am very concerned my husbands buisness has failed we are three months behind with our mortgage with birmingham midshires they are threatning to reposses our home we have three children at home but the youngest is 18 so i dont think the council will rehouse us as a family my husband is desperatly seeking employment but as our mortgage is£900 a month i very much doubt if we could pay it please can somebody give advice on what we can do

Hi Jean, I am currently fighting off my lender for repossession, they put a suspended order on my property in September as long as I kept to their arrears repayment programme. I have Court hearing on Friday to try and stave off their action and their threat to repossess because of accrued arrears following recent illness.What stage are you at - have they applied to Court? Have they got Money Judgement Order? I am trying to use the Norgan rules to apply arrears over lifetime of mortgage, but its up to the judge on the day! I have been searching for new lender, remortage etc but to no avail...but will update you following Friday's Court case.

hi peter, thank you for replying to my query, i am sorry to hear of your pending case. my society are only threatning me with proceedings at the moment we have not yet been to court. i do not know what the next step will be or when. my main worry at the moment is getting rehoused if we can not sort it out. my e mail address should be o.k. i have had other e mails today. good luck on friday i will be thinking of you. keep in touch. if the worst happens what will you do.

Dear Jean Just to roll back have you prepared a financial statement? this is the first form of defence email me and I will email it to you for free its in excel format.Prepare a defence and answer every letter the courts are there to help you not to take possession as most think. Regards Adrian
