More Marriage Questions

I have a complicated situation with some "what if" scenarios that I'd like some help with. Here's the situation:

My fiance and his ENTIRE family (parents, older and yonger siblings, aunts, uncles, cousins, etc) applied for Visas about 9 years ago. He was 17 at the time. After a few years, everyone in his family had been granted a visa except him. They assumed his was just a few weeks away and moved everyone, including him as a stowaway, to the US. They thought it would only be a short time before his came through and then everything would be okay. Well, it has been 9 years and he still doesn't have one. In the meantime, he has been living and working here illegally (about 5 years).

We would like to get married, but I know how drawn out and complicated that can be with an illegal alien. I was wondering how it would work out if he went back to Mexico and waited while either I applied to bring him here as a fiance or if we got married in Mexico and he waited again for me to file the necessary papers. How much is his once living here illegally going to affect this whole process? Or would it just be better to lay low and hope the law will change? I know the best thing is if his papers suddenly went through, but somehow I doubt it.

PS we have a baby on the way in a few months. Will this fact help to speed up the process in any way? Thank you for your help.

i am in the same situation as you....he came here illegally 4 years ago on no visa with his brothers and sister..im trying to find out what he can do so far i found out that he can file for his temporary residence card he cant file for his permanent yet and niether can your fiance because they entered illegally from mexico and our baby can petition for him to get his papers easier.. since you are his fiance you can petition for him and so can the baby...it just really sucks that people from mexico have to sneak in to our country and be forced to take fake names and fake ss numbers because their country gives them a very hard time..they are people not animals i hate the term papers it makes them sound like a dog...do a web search type in us immigration laws you will find all of the documentation you will need and information..do not fill anything out let him do it since he is the one filing

sssssssssssssssssssorry your wrong the baby cannot petition for him untill he's 21 yrs old,and you have to marry with in 90 days here after bringing him in on visa k-1 also if he needs waviers on past records thenll itll be more time other only 3 mths maxium waiting
