HELP : LUSENET : Repossession : One Thread

My house was repossessed about 7 years ago too, the lender contacted me last year, I was scared and did not answer their replies, now they want 23000!!!!! I am too selling my house and want to know if the lender can stop the selling of it. Would the lender have put a second charge on this house , and would our present lender know or the solicitor selling my house. I do intend paying something but not 23000! Shall I offer something before the sell goes through or wait?

I would first Sarn the lender and put them to strict proof of the alleged debt before thinking about making an offer, see copy of Sarn letter on "Repossession" page. Did they sell your property for a fair price. Who did they sell it to ? An employee of the building society or estate agent ? Of course, all this could take a substantial amount of time. To obtain a charging order the lender needs to go to court. I believe you can check with Land Registry whether or not they have placed a charge on the property. You can also find out who the property was sold to from Land Registry. Let us know how you get on. Good Luck and don't panic, I'm sure you'll get it sorted.

thanks, I have checked the land registry, there is no 2nd charge on property which we are selling, can thay stop the sale going through before completion date? and would we know about it?

also, I cannot find a copy of the sarn letter as advised and what doe SARN mean exactly and can you put a sarn letter on this answer for me many many thanks sara

If you click on the "Repossession" title in the box (top left on screen under Options) you will find the letter under "Sample SARN letter" some 6-7 lines down. SARN = Subject Access Rights Notice.
