Am I liable for my Husbands debt frm before we met

Dear anyone who knows more than me,

I am just about to take on Abbey National/Eversheds afrer trying to avoid it for the past 13 years. After reading this site (never new it existed until last week) I have issued the Abbey with a SARN and am awaiting a responce but last week recieved a Financial Declaration they want completed and returned (no chance) and on it it is asking for my details as well as my Husbands. The debt is from a repo from 1991 and I wasnt on the mortgage only my Husband and his dissapearing EX! Will they hold me responsible now as we are married? Also how easy is it for them to put an attachment to our current house so that when we sell they will get their money?

Please help I need to know as much as poss to take these bloodsuckers to the cleaners! Thanks Debbie

Hi Debbie,

They have no right to ask for any of your financial details, even though you are married you had absolutely no part in this debt, it was in relation to your husband and his ex.

As you say don't fill in any of the financial forms they send you, in fact you can complain harrassment on your part as this alleged debt has nothing to do with you.

I am in a similar position to you in that my fiance and I are getting married, however the house is in my name only. As you have a joint mortgage and joint ownership on the house they could come after it, but you are doing the right thing in challenging them, sending the SARN and following the dos and donts on this section.

It is more worrying when you have a property, but as it is now 13 years old I would go along the 12 year time limit route - tell them they are now out of time and you want them to stop harrassing both your husband and yourself.

Apart from the advice already received I would suggest you look at my posting to Natasha under "Should I pay up??" dated 8 Sept 2003, in fact read as many postings as you can, you can glean a lot of info from them. Make sure you do not acknowledge the debt, see advice in aforementioned posting. Good Luck.

I forgot to add that you might want to consider protecting your current property (if it's a joint mortgage). The way to do this, I understand, is for whatever interest your husband has in his current property to be bought out from him at its current market value. In other words your husband's beneficial interest in the property (equity to you and me) must be bought at the going rate. I have a little more info on this if you need it.
