MORTGAGE EXPRESS - SETTLEMENT

greenspun.com : LUSENET : Repossession : One Thread

Firstly both Elizabeth and I would like to say a big thank you to all who have visited our postings on this website, over a considerable period of time, given staunch support and good advice ~ THANK YOU SO MUCH.

You will be pleased to see, from the letter received from Mortgage Express today and printed below, that they have decided to accept our offer ‘in full and final settlement’ of their alleged shortfall. Below this we have printed our reply. This was great news for Elizabeth, when I visited her in hospital today, and I am sure will provide a wonderful boost towards a recovery. She is far from ‘out of the woods’ yet, however I am hopeful that this will be one of those steps towards giving her the will to continue living and not give up just yet.

Mike.

PS Sorry not to include the two letters ~ the server will not allow that size of file. I shall try again later.

Dear Mr & Mrs xxxxx

Re: Account Number xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx

I acknowledge receipt of your letter of 22 December 2002 in respect of the above.

I refer to your letter of 24 May 2000 in which, as you say you advised us of your health problems, which you did. However you did not go into any depth, indeed you provided only a single sentence in this regard and have made no further mention since, until our specific enquiry.

I have of course updated myself with the current postings on the web site and note that for the sake continuity you have posted both my letter to you and your reply. The only comment I would make is not in the posting, I have no objection to that or the posting of this correspondence, but I would think it good manners to delete my name details as well as your own.

Be that as it may, I confirm that we will accept your offer of a cheque for £1,500.00 in full and final settlement against the shortfall of £28,146.87 and will provide a letter of satisfaction upon clearance of the cheque.

Yours sincerely
