ABBEY TELLING LIES AGAIN?

greenspun.com : LUSENET : Repossession : One Thread

I've been doing lots of investigating after SARNING the Abbey, in relation to them underselling my house. They told me they had received no offers other than the one from the person who eventually bought it.

After tracing someone who bought an identical house on the same estate, I asked him why he didn't view or buy my house which was on sale at the same time as the one he bought (mine had a conservatroy). He paid much more for the one he bought.

Well he e mailed me tonight and told me he DID view my house and he put in an offer which was rejected. He put in an improved offer which was also rejected. I've now asked him how much he offered aand await his reply.

I have it in writing from the Data Protection Manager at the Abbey that NO PREVIOUS OFFERS were received.

WHAT DO YOU MAKE OF THIS AND WHAT DO YOU THINK I SHOULD DO NOW?

I'm like a big dog with a HUGE bone and I'm not letting go!

The Abbey are lying swines! I'm really angry!

Response to ABBEY TELLING LIES AGAIN!

I am in a similar position, except that I knew at the time that this was going on. Friends and relations tried to view the house and the viewings were cancelled at the last minute. I knew that the first offer was by a relative or employee of Halifax and compained as there were no particulars and no adverts in the paper. I managed to get the offer increased on the house, but asked for this to be investigated, and now I have found on my SARN that nobody ever investigated it at all.

I'm hoping someone can give me some advice on where this will get me too!

I think you should complain to Abbey about this, make a formal complaint to the Abbey Secretariat and ask for a deadlock letter so that you can complain to the Ombudsman when Abbey ignores your complaint.

Then make a complaint to the Ombudsman.

Then sue them in court.

Then set the dog on them. (Get pictures please)

Good Luck.

I had my house valued 3 months before my repossession and they (Abbey) sold it to the Estate Agent for £12,000 less than my valuation claiming this was the only offer they had received. I know this does not aid your situation but you are not alone in being stitched up by the Grabby National, they are Pants and so are Eversheds come to that

I agree with Harry. I would also complain to the MCCB, there is a legal duty to sell the property for a fair price. The Mortgage Code says under 10.1 We will comply with the law and relevant codes of practice or similar documents which are followed by members of the Council of Mortgage Lenders....see price,http://www.mortgagecode.org.uk/downloads/mortgagecode.pdf

Though you would need to exhaust the lender's own internal complaints procedures first, but I would certainly contact them and obtain their advice.

For those who haven't already I would get your local MP involved quoting Mike Hancock's EDM 62 (on repo page), and if your MP is unhelpful I'd contact Mike Hancock himself.

Mark.
