greenspun.com : LUSENET : Repossession : One Thread

HI, HAS ANYONE ANY DETAILS OF THE THREE CASES THAT ARE NOW BEING HEARD (GLOBAL VS JONES, SECURUM VS ASHTON AND HALIFAX VS GRANT) IN THE COURT OF APPEAL. THE REASON I ASK IS I HAVE HAD A LETTER SENT TO ME RE CURTIS SOLICITORS STATING THEY ARE PREPARED TO WITHDRAW THE STATUTORY DEMAND RE A MIG PAYOUT(£15,000) BY R,S,A. THEY SAY AS THESE CASES HAVE A SIMILAR QUESTIONS RE THE LIMITATIONS ACT THEY ARE HAPPY TO PLACE MY CASE IN ABEYANCE UNTIL SUCH TIME A DECISION HAS BEEN MADE BY THE COURT OF APPEAL. BY THE WAY THIS LETTER HAD A WHOLE NEW (NICE) AIR ABOUT IT. IF ANYONE HAS ANY INFO RE THESE CASES I WOULD BE GREATFULL. ALSO SHOULD I JUST WAIT NOW OR TRY TO SETTLE WITH A SMALL OFFER, I ASK THIS BECAUSE IF THESE INDIVIDUALS LOOSE THE CASES THIS MAY PUT THE NAIL IN THE COFFIN AND SOME OF US OUT THERE MAY BE IN A WORSE POSITON. CHEERS. G.C.

The caps lock key has two positions, ON & off.

Good Luck.

The upcoming cases may or may not pass judgement on the issue of MIG payouts being simple or specialty debt. It's clear to me that the lenders are ALL uncertain about this issue and are hoping that the law will be clarified in their favour. If the matter is not resolved however, I would suggest that you carry on as though it had been judged to be a simple debt ie. six years for bringing recovery action in a court of law from discovery of the debt.

Does it really matter about the Caps - for God Sake - the Man needs help - not critisism!!!!!

Hi there

I do not know specifically what issues the CA will decide, but the cases are currently being heard (started yesterday (24th)). May not get judgment until after the summer break.

Charming, just charming. I made a simple comment about capital letters being used and I get sworn at. Just charming.

When I check out Q&A items, which is something I do every couple of days in an attempt to offer my advice to anybody who might benefit, it is a bit difficult to read something which is written totally in CAPS. It appears that the person is shouting at you.

There have been a number of examples of people using capital letters in their Q&A articles in the past. And I fully agree with previous comments on these CAPS articles that their is no need to shout. I tend to actually ignore articles that are shouting at me, I have my own problems at present to deal with, and I don't need to be shouted at, or sworn at for that matter.

Good Luck with your problem, I sinceley hope you get it sorted.

I agree Harry with your reply, I actually found your original comment amusing and would expect it to be received as such. The response you received was both over the top and offensive. Don't let this put you off contributing to this excellent self help web site and for all concerned - let's put it to bed.

It would have ben amusing had he bothered to follow up the sarcasm with some helpful advice!
