Rick Stanley: Trial postponed.

[February 1] Due to "legal ramifications," the civil disobedience trial of U.S. Senate candidate Rick Stanley in Denver, Colorado has been postponed to March 5.

Stanley, who was arrested and charged with violating a local anti-gun ordinance at a Bill of Rights Day rally, said his lawyer requested the postponement from the original January 30 date due to a scheduling conflict

More time was needed to file a "severance motion" between him and another man who had been arrested on the same charge, he said. The Denver District Attorney's office is pushing to try the two men together.

"The system tends to operate extremely slow, at least on the city or municipal level," said Stanley. "And I want a jury trial, so it might be even longer before my case is heard."

After giving a speech in which he recommended that citizens launch a peaceful "Second American Revolution" at a December 15 rally, Stanley had stuck a pistol into his belt. He was promptly arrested by officers.

The 46-year-old businessman had notified local police in advance of his plan to violate the ordinance, which forbids an individual to openly "carry, use, or wear" a weapon within city limits.

His act of civil disobedience violated Denver Revised Municipal Code 38-117.5(b), which carries a penalty of up to one year in jail and a $999 fine.

However, Stanley said he was optimistic that the ordinance would be struck down.

"[The ordinance] clearly violates both the U.S. Constitution and the Colorado Constitution, which is what my lawyer is going to argue in court," he said. "But it's possible I could end up spending a year in jail. This could be a long process."

Stanley currently faces no opposition for the Colorado LP's nomination for U.S. Senate, which will be decided at the state convention in May.

Evolve? I dont think that I have evolved. I just get stuck on an issue and cant let go. Right now it is taxes. And my beleif that we would all be better without them. A tax credit for a family of four? Wouldnt no taxes be better?

Sometimes I talk about Homosexuality and how the government has no right to interfere in an individuals sex life, one way or the other. I defend gays and lesbians even though I am neither. Because some of those same homophobic people think that anything but missionary with your wife is wrong. I dont want those people making any kind of decisions for me or you.

Or racism and how racists are really misinformed but at the same time black culture is what is holding them back. That and Government forced Affermitive Action. Lower the bar in school and then they get into the real world with white kids who have had a high bar their whole life and of course they wont do as well. The best thing to do is to raise the bar for innercity schools.

Maybe this little war. We should defend ourselves. That I agree with. If they attacked once they will again so this is as much defence as it is retaliation. But War was never declaired. They have given, or should I say allowed, the President too much power. And not just Bush. Every President starting with FDR. But at least FDR declaired War. A declaration states the enemy. And, I guess, to an extent, the goal. Bush has done none of these things. All he has done is take away more rights in one year than Clinton did during all eight. My patiance with his little war is wearing thin.

The main thing is that government is bad but nessisary and therefore should be kept at a minimum.
