Poe had no heirs and whatever copyright he may have had(which didn't exist much back then?) is expired. BUT using texts, especially copies from a site or book need permission from the editors of such. Address inquiries to www.eapoe.org The Edgar Allan Poe Club of Baltimore which is knowledgable about these matters. I should think using his name is public domain anyway.
