URGENT! - Threatened with bankruptcy!

greenspun.com : LUSENET : Repossession : One Thread

I have received a letter from Hammond Suddard Edge demanding £32k in shortfall debt. In total I have received 4 letters from them. This time they are threatening bankruptcy. In the past I have not responded to any of the letters, but now I need to do something. I am very worried. The lender is Britannia Building Society.

I gave the keys to a property back in 1989/90/91 and have not heard anything until last year. I have no details about the property, when sold, how much etc. When I gave the keys back I left a forwarding address. I was told that handing back the keys would be the end of it.

It has taken me 8 years to get my life together again and now these bastards want to take it away again. They know I have a property with equity.

Please, please advise me on the best course of action.

thanks kumar

First question. When EXACTLY did you hear last year fro the first time?

The answer to that changes how to reply a great deal. In the mean time have a good read og the repossession section of thismsite especially the do's and dont's. In there is a list of what you shoud ask for. If you draft a letter and e-mail me a draft I can have a look for you if you want.

But please can you give us the definative answer to the first question. In the meanwhile do not worry too much about the bankrupcy thing. In my opinion it is just another of many many threats that these people use to scare us into paying up without proof.

Don't worry too much I have received two letters over the last eighteen months threatening the same yet nothing has happened. The Abbey National's solicitors DLA starting writing to me at the end of January 2000 just before the six year limit regulation came into effect. I have ignored all letters and have not heard anything since May, this is despite receiving two identical letters except date stating that they would petition the courts for my bankruptcy in four days! Read the site and keep up to date with the question and answer page for relevant info. Good luck

I am also now being threatened with bankruptcy, after 10years although the lenders and their solicitors have not answered any of my questions and their letters are riddled with inaccuracies, spelling mistakes, which don't inspire confidence!!!

its all hot air, however get your facts, dates conditions etc all ready.Bankruptcy is easy to threaten by a big company on a private individual. That why they do it,if they could get your attention another way they would try that.Trawl through all the q/as that cover this and get cracking at them.
