Attachment of Earnings Orders

greenspun.com : LUSENET : Repossession : One Thread

I am being chased for #15000 shortfall but intend to emmigrate abroad early next year. I am in receipt of a government pension. Question can an attachment of earnings order be placed on the pension when I am abroad. I will not be coming back to this country.

Attachment of earnings orders can only be applied to people who are in employment.

With AOE orders, there is a protected amount that a person can earn (depends on circumstances) before the creditor can get any money - ie if the debtor earned #150 a week and the protected limit was #100, the court might award the creditor #20 of that remaining #50. If the debtor earned only #80 in a week, the creditor gets nothing.

Hope this helps
