There is a very interesting piece on this case "Cheltenham and Gloucester -v- Norgan at:

http://www.parliament.the-stationery- office.co.uk/pa/ld199697/ldhansrd/pdvn/nineties/text/60708-42.htm

See 8 Jul 1996 : Column 155.

Hope this helps in some way.

I've just noticed that because of word-wrap there has been a space added in the URL ie. "stationery- office". The link won't work with this space in it. So once you've copied & pasted in the address field of your browser just cursor along and remove the space before pressing enter. Then it will be OK.

C&G v Norgan - Court of Appeal - 14.12.95 - Starting point for repayment of arrears of mortgage is the balance of the mortgage term.

#20,000 arrears - 20 years left on your mortgage - #1,000 p.a. (div.x12)(plus interest) on top of your normal mortgage payment - is the starting point.

Good luck - Vic
