How do I know if my lender has issued legal proceedings ? : LUSENET : Repossession : One Thread

About 10 years ago I handed the keys back to my lender, Halifax B. S., they wrote to me advising that I may be responsible for any shortfall. 3 weeks later they sold the property at a loss of about #50k and wrote advising me of the sale. I have heard nothing else (they cashed in my endowment policies), I moved some 3 years later so if the Halifax wrote to my old address I wouldn't know about it.

I understand that under the six year rule if they hadn't issued legal proceedings against me I can assume that all is well and can get my blacklisting removed.

How can I find out if the Haliax has issued proceedings against me, I'm concerned that if I contact them I will start the ball rolling again.

I'm currently being chased by Halifax and the information they have given me is that the 6 years starts from the date of sale. If they haven't managed to contact you during the 6 years then they've left it too late. HURRAH! I'm very pleased for you - don't worry about this anymore!

I may be wrong (someone correct me please!) but you won't get the blacklisting removed. It will stay there in various guises, but with the note that it is "spent" i.e. beyond the statute of limitation sto collect. When you apply for another mortgage it comes up, every time, six years expired or not. My [mortgage]credit file is ruined by this information staying on it and there is nothing I can do to get it off apparently. I tried writing to the various bodies and was ignored for months; when I questioned how, after so many years, this information was still showing up, I was told that it was a "tar baby" - that is it will stick to me for good.
