What is a Hate Crime

A hate crime is a crime in which the perpetrator's conduct is motivated, in whole or in part, by hatred, bias, or prejudice, based on the actual or percieved race, color, religion, national origin, gender, disability, or sexual orientation of another group or individual.

Can hate crimes laws be used against hate on the Internet?

If a bigot's use of the Internet rises to the level of criminal conduct, it may subject the perpetrator to an enhanced sentence under a state's hate crimes law. Currently, 40 states and the District of Columbia have such laws in place. The criminal's sentence may be more severe if the prosecution can prove that he or she intentionally selected the victim based on the victim's race, nationality, religion, gender or sexual orientation. However, these laws do not apply to conduct or speech protected by the First Amendment.

Granted this is offensive and juvenile. But the moderators could just delete it.

If the use of a patently offensive word is no longer protected, and this individual gets prosecuted, why is it that equally offensive images, sexual or anti-religious in nature, are considered protected speech under the 1st amendment?

Surely this double standard is visible to all. The "n" word rates the user a jail term, yet we are powerless to clean up an increasingly degenerate culture we find ourselves mired in.

INTERNET SERVICE PROVIDERS (ISPs) REQUIRE THAT THE OFFENDING MATERIAL STAY IN PLACE AS EVIDENCE THAT A TERMS OF SERVICE (TOS) OFFENSE HAS BEEN COMMITTED. It is too easy to fake a TOS violation.

If you would take the trouble to read the sysops' responses above, you would know this already. The above repugnant material has been left in place for an evidentiary reason AND THAT REASON ONLY. You guys have NO IDEA what kind and how much offensive material has been deleted in the past. And, guess what? You won't find it in the Debunkers file of TB2K deletions.

My 15 year old son and his closest friend, practically joined at the hip for the better part of a decade are a portrait of harmony. The above term and it's white equivilant(s) are nothing more than pet names routinely and playfully shot back and forth between these two. So neutralized is it that roles are just as apt to be reversed with blonde son being addressed with the n-word and vise/versa. These 15 year olds make a mockery of you BOZO. YES, it is a very offensive post. That is why the sysops are letting this stand; they are going after the thread originator. If it is removed, they can't. As nasty as it is, I for one, am willing to let it stand if it will help pull the plug on the cretin who wrote it.

Yes, it might be 'nicer' if it were quickly deleted, but then the evidence that this happened would also be gone, too, and the perpetrator won't even be able to have his/her hand slapped.

Interesting reactions all around. Since my children's grandfather was half black, I guess I could be offended by this fellows words but what would be the point?

If he is constantly posting and harrassing people, charge him. I don't believe what we see here is a 'hate' crime anymore than asking a polly if it wants a cracker is a 'hate' crime. What is the crime? Is it not being politically correct? Is it the use of offensive language? Is that a crime? Perhaps we need to move to China where we can be protected from varying points of view. I understand they have no trouble with people speaking their mind over there.

Seriously folks, the person is trolling and he got you. Sysops, warn him about a dozen times, then charge him. This post alone isn't going to even get charges and if it does, the law needs changing. The guy is an idiot, not a criminal. Usually criminal speech requires an accompaning threat at the VERY least. Name calling won't get it.

Just to point out... the Sysops are pretty darned tired of dealing with repeat flammers, spammers, trolls who just cant seem to allow a group of people to discuss what they want to, within very loose boundaries. Dealing with them is total waste of energy, and a pretty thankless task, IMHO.

One of the Sysop team is highly offended, with reason, and chooses to report the poster to his ISP for action, rather than deleting. This is not the first time for this one.

Perhaps trully offensive posters will think twice before game playing? Well see. The Sysop chooses to try this route, and I for one, am willing to see if it garners action. The thread will be deleted after there is an abuse response from the posters ISP provider.

Dianne; I did mention warning and then pressing charges. I understand what it is to be a sysop and I sincerely appreciate the time and effort you folks put into this task. Repeat offenders should be warned about three times and then charged if possible. My point was that there is no actual violation of the law here (because of content, thank God) there may be one because of harrassment.

I in NO way approve of this fellows behavior, but then I don't approve of Bill Clintoon's behavior either. Approached properly his ISP will have no option but to discontiue the fellows service.
