WAR POWERS

greenspun.com : LUSENET : TimeBomb 2000 (Y2000) : One Thread

I found this on the net this afternoon. It both shocked me and terrified me, in regard to what we may all be facing re Y2K. I have not learned how to post a link as yet, but hopefully, one of you who is more capable than I can do so from this info. The info is at: "members.aol.com/FTUN/WARPOWER.html" Anyone concerned about any hope of a possible future after Y2K, I believe should read this and pass it along to as many people as possible.

Thanks for the link. I've been telling people for years what I think of FDR. Clarifies.

(Ezek 39:10 KJV) "...and they shall spoil those that spoiled them, and rob those that robbed them, saith the Lord GOD."

-- Mark Hillyard (foster@inreach.com), January 18, 1999.

I think we should demand that congress repeal the War Powers act on pain of a tax revolt.

That sure isn't anything they teach in school now is it? Do you all realize that this forum is intercourse between the enemy? We can all be arrested, and our property siezed. I was always sure that it would be the crazies that would cause the problem. Now?

-- sam (we're@theend.com), January 19, 1999.

NO......They certainly don't teach this in school! In fact, I doubt that most people have ever been aware of this......I know I certainly wasn't........But I do believe EVERY US CITIZEN needs to be made aware.....ASAP......with Y2K staring us in the face, and Clinton/Gore in the White House........we're ALL in BIIIIIGGGGG TROUBLE!!!!!!!! This gives both of them, the "POWER" to do anything they damn well please regarding people, property, food, firearms, ammo, EVERYTHING!!!

This is not new information. "They've" had this power since, as the report states, the time of FDR. The War Powers Act was never rescinded. Plus, any president may revoke the constitution at any time by Executive Order as well...and none of this was ever taught in any school I ever attended...(born in the Year of The Bad Water, 1952). Uh, yep...the land of the free, and the emperor has been buck naked for long long time.

Two cents thrown.

Donna,

>"They've" had this power since, as the report states, the time of FDR.

... and have any past uses of this power reached the demonic depths being attributed to Clinton by some of his attackers? No. Not even Nixon.

>Plus, any president may revoke the constitution at any time by Executive Order as well

No, that is not true. All Executive Orders derive their authority from the Constitution, so inherently cannot revoke it. An EO is not a constitutional amendment.

Some Clinton-attackers like to ignore this connection, and have never refuted it when I've pointed it out.

One of Clinton's staff (Carville?) made an arrogant statement about "stroke of the pen, law of the land", or something similar. His dumb comment (at least, out of context -- I haven't seen the context of it) does not rise to the status of a federal law, a Supreme Court ruling, a Congressional resolution, or an Executive Order. It simply does not have the legal status that Clinton-attackers seemingly want to attribute to it in order to set it up as a target.

>...and none of this was ever taught in any school I ever attended...(born in the Year of The Bad Water, 1952).

If my eighth-grade civics class had covered executive orders, we might have fewer spout-offs about them now.

>Uh, yep...the land of the free, and the emperor has been buck naked for long long time.

As has been true in all other administrations I've seen, the President's opponents portray the land as less free than it really is. But it is distinctly more vicious this time than during any other in my lifetime.

Well, maybe Nixon ...

... no, not even him, presidential-election subversion, wage-price controls, and all!

(Trivia question: how many Vice Presidents resigned from office to which they were elected at the same time as a President who later resigned? :-)

... and if I don't post this clarification, sure enough someone's going to flame:

I support repeal of the War Powers Act, the sooner the better.

Over twenty-five years ago I thought the extent of Presidential emergency powers was dangerously vast. I wrote to my Republican Congressman about that. He was disinterested. He was elected from a district that practically always elected Republicans to Congress, so had little incentive to listen to proposals that would tend to diminish the power of the then-Republican Presidency.

Thanks No Spam, You had me a little confused at first, but was very glad to hear in the end, that you agree, that this is something that needs to be addressed and recinded. I just can't understand for the life of me, how people have ignored this all these years???????? I'm 53 and this is the FIRST TIME I HAVE EVER HEARD,READ,or BEEN AWARE that this sort of thing existed. WHY????????? WHERE HAS THIS INFO BEEN HIDDEN?????? WHY DIDN'T OUR PARENTS PASS THIS INFO DOWN TO US???????????? HOW HAS THE GOVERNMENT KEPT THIS OUT OF THE PEOPLES AWARENESS RANGES?????????

NOW WE HAVE TO DO SOMETHING ABOUT IT........HOW?????.......I'M NOT SURE AS YET.......BUT JUST PASSING THE INFO TO AS MANY AS WE CANM WILL CERTAINLY NOT DO ANY HARM AT THIS POINT !!!!!!!!!!!!

Sandy,

>I just can't understand for the life of me, how people have ignored this all these years????????

How many "ordinary" people (not lawyers, politicians, or radicals) do you know who have been interested enough in constitutional law or civil liberties to do much reading-up on those topics?

I became interested in those topics while in college. It may have started with some programs I heard on public radio, KPFK, in Los Angeles.

Then when my birthdate was drawn as #2 in the draft lottery in the fall of 1969, I became intensely interested in my legal rights vis-a-vis a government that wanted to send my warm body to a SE Asian jungle (especially when a draft counselor told me that my local draft board, in a city 2000 miles away from him, was nationally infamous/famous for denying all appeals of draft classifications).

So I went to the campus library and started reading about Selective Service regulations and civil liberties, subscribed to the Center for the Study of Democratic Institutions for a while (their pet project was rewriting the Constitution), and joined the ACLU (the vast majority of their cases are noncontroversial and dull - you don't read about those in the paper -- the janitors whose employers treat them illegally and so on ...). Subscribed to the Congressional Record for a while in 1970, until the price went up.

>I'm 53 and this is the FIRST TIME I HAVE EVER HEARD,READ,or BEEN AWARE that this sort of thing existed. WHY????????? WHERE HAS THIS INFO BEEN HIDDEN??????

It hasn't been hidden. But how often have you had the urge to sit down in a library to read the United States Code? Or Selective Service regulations? Or other dull legal material?

>WHY DIDN'T OUR PARENTS PASS THIS INFO DOWN TO US????????????

Were they lawyers, politicians, or radicals?

>HOW HAS THE GOVERNMENT KEPT THIS OUT OF THE PEOPLES AWARENESS RANGES?????????

It hasn't. How much of your time is spent haunting the legal department of your local library? It's all there, paid for by your local taxes, most likely, just as it has been for years and years. (Here I'm assuming you're in an urban area.)

-- No Spam Please (anon@ymous.com), January 20, 1999.

I understand what you've explained......but I still want to try and DO SOMETHING to change this. Any ideas, suggestions, etc will be appreciated........

Thanks again,

Sandy PS I am in an urban area......just outside Naples, FL!

-- Paul & Sandy Stambaugh (patches96@worldnet.att.net), January 20, 1999.

Paul and Sandy. At this late stage in the game the best thing you can do is buy a couple of AR-15's, lots of ammo, and lots of food. Take a look around and see if you can ride out massive civil unrest at your present location, If not get out. Y2k is going to change a lot of things in a major way. There is a very real possibility that the present government will not survive it. The trick is to out live them.

-- Nikoli Krushev (Doomsday@y2000.com), January 20, 1999.

Nikoli Thanks for the reply, at least I know I got this info out to a few people(for possible future reference)if nothing else. I'm sure you're right about what we need to be doing at present. We are storing, and we are planning to stay put, I just really hope you're right about the present government not surviving......we'd all be much better off in the long run.......as long as we can survive and out live the bastards! I certainly plan on doing my very best to do just that!!!!!! Thanks again, Sandy

NoSpam sez-- "All Executive Orders derive their authority from the Constitution, so inherently cannot revoke it. An EO is not a constitutional amendment."

Just so. But I think the War Powers Act permits the Executive to suspend certain provisions therein. In fact, that right is provided in the Constitution, as cited in the link Sandy found. For cause, of course. This was exercised in 1942 when Japanese and Japanese-Americans, even if American citizens, were forcibly removed from their homes and placed in internment camps.
