The upcoming cases may or may not pass judgement on the issue of MIG payouts being simple or specialty debt. It's clear to me that the lenders are ALL uncertain about this issue and are hoping that the law will be clarified in their favour. If the matter is not resolved however, I would suggest that you carry on as though it had been judged to be a simple debt ie. six years for bringing recovery action in a court of law from discovery of the debt.
